- Information on how to enter and details of the Prizes form part of these Conditions of Entry (Conditions). Entry into the ‘Berri WIN a $10,000 Family Holiday Promotion’ (Promotion) is deemed to be an acceptance of these Conditions.
- Promotion commences at 12.01 am (AEST) on 30 May 2011 and entries close at 11.59 pm (AEST) on 24 July 2011 (Promotion Period).
- Entry is open to Australian residents only. Employees (and their immediate families) of the Promoter, its agencies and companies associated with this Promotion, are ineligible to enter. Entrants under 18 years or age must have parental/guardian approval to enter and the parent/guardian of the entrant must read and consent to all of the Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of their consent to their minor entering this Promotion.
- To enter this Promotion, you must during the Promotion Period:
- purchase any 2 Berri products excluding Berri Australian Grown products (Promotion Products) from a participating IGA or Foodland store;
- retain your original purchase receipt(s) (Original Purchase Receipts) and the original barcodes (Product Barcodes) of the Promotion Products;
- submit an SMS Entry or Online Entry by either:
- (SMS Entry) sending an SMS message to 1977 7788 containing the following information in the following order:
- FIRST: the last four digits of your 2 Product Barcodes;
- SECOND: your first name;
- THIRD: your surname; and
- FOURTH: your postcode,
- (Online Entry) log on to the website www.berrijuice.com.au (Website) follow the links to the promotional pages and fully complete the online entry form by providing your first name, surname, address, telephone number, email address, Product Barcodes and any additional information as required by the Promoter.
- Entrants are responsible for the costs associated with accessing the Website via an internet service provider. For entrants who enter via the Website, there is no additional cost to participate in the Promotion other than the cost to access the Website via an internet service provider.
- SMS call cost will not exceed 55 cents including GST. SMS Entry into the Promotion must be contained in a single SMS from the entrant’s compatible mobile phone connected to an Australian based mobile network / service provider which permits premium text messaging to the promotional SMS number (being any one of the Telstra, Vodafone, Virgin or Optus mobile digital networks or a participating service provider which has SMS compatible mobile digital phones). SMS entries submitted via the internet are not valid and will not be accepted. The telephone number of the mobile telephone from which the SMS is sent must not be withheld. A return SMS will be sent to each entrant who submits a valid SMS Entry to confirm receipt of their entry. The SMS provider is Prime Focus, telephone 1800 818 957.
- The mobile phone number from which the entrant sends the SMS Entry must be owned by the entrant. The Promoter may require a winner to validate their entry by showing proof of ownership of the mobile telephone number. The only acceptable proof of ownership will be an original invoice in the name of the entrant or an original letter on the service provider’s letterhead confirming the entrant’s ownership. If an entrant is unable to provide proof of ownership of the mobile telephone number within 14 days of request by the Promoter, the entry will be treated as void and any Prize awarded to that entrant will be treated as an unclaimed Prize.
- Individuals can submit multiple entries but there is a limit of five entries per household per day, and only one entry may be made per 2 Promotion Products purchased. There is a limit of one Minor Prize per entrant, and five Minor Prizes per household. Unrecognised Product Barcodes will not be accepted. Errors and omissions in entries may be accepted at the Promoter’s discretion.
- Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will void all entries by that entrant.
- The major prize is a $10,000 (inc GST) Flight Centre Limited Gift Card (Major Prize). The provider of the Major Prize is Flight Centre Limited (ABN 25 003 377 188), telephone (03) 9026 3859. Flight Centre Ltd is not associated in any way with this Promotion.
- The minor prize is a $200 (inc GST) IGA or Foodland branded gift card (Minor Prize). There are 100 Minor Prizes to be won. The provider of the IGA gift cards is Metcash Trading Ltd (ACN 000 031 569) and the provider of the Foodland vouchers is Impeach Pty Ltd (ACN 008 143 959). Metcash Trading Ltd & Impeach Pty Ltd are not associated in any way with this Promotion.
- Total Prize pool is valued at up to $30,000 (incl. GST).
- The value of the Prizes is accurate at the date of commencement of the Promotion Period. The Promoter accepts no responsibility for any variation in the value of the Prize after that date. The Prizes cannot be transferred, exchanged or redeemed for cash. Where a Prize is unavailable for reasons beyond the Promoter’s control, the Promoter retains the right to substitute the Prize with a prize of equal or greater value, subject to the directions of any of the relevant State gaming authorities.
- Major Prize conditions of use. Redeemable with participating Flight Centre Limited Stores, within Australia. Not redeemable for cash or travellers cheques. The voucher expires twelve months from the date of issue. It is the responsibility of the voucher holder to use the full value of the voucher within the validity period. Any unused balance will not be refunded or credited when the voucher expires. Where the cost of purchase exceeds the available voucher balance, the voucher holder will be required to make up the difference between the purchase price and the voucher balance. Flight Centre may not accept use of the voucher on a sale under $20. The Promoter is not responsible for any lost or stolen vouchers. Flight Centre Limited may charge a fee for the replacement of lost or stolen vouchers. Defaced, mutilated, altered, lost or stolen cards will not be replaced or redeemed. The voucher cannot be used for payment of credit or retailer accounts, and cannot be reloaded. Flight Centre may change the terms of conditions of use at any time. All costs in excess of the voucher value, including but not limited to insurance, taxes, meals, drinks, and transfers are the responsibility of the winner.
- Minor Prize conditions of use. Redeemable at IGA or Foodland branded stores within Australia (depending on whether the gift card is an IGA gift card or a Foodland voucher). The participating stores that accept gift cards may change from time to time. Lost or stolen gift cards will not be replaced or refunded. The gift cards expire 12 months from the date of issue. If a Minor Prize winner advises the Promoter (within the period of time allowed by the Promoter) that they cannot redeem their IGA gift card due to their location of residence (SA), the Promoter may, in its discretion, provide that winner with an alternative $200 Foodland voucher. The alternative Minor Prize will be awarded in lieu of the original IGA gift card.
To use the IGA gift card, you must present the gift card to the sales assistant/operator at the service desk/checkout at the participating IGA store where purchasing goods or services and enter the 4 digit PIN (which is located under the scratch panel on the back of the card). Following a successful transaction, the remaining value of the gift card (if any) will be that proportion of the initial value of the gift card which is unspent immediately prior to the transaction, less the value of the goods and services the subject of the transaction (Remaining Value). The Remaining Value may be used in whole or in part for future purchases at participating stores in accordance with the full terms and conditions of use which are available at www.iga.net.au. No change will be given in respect of any transaction. The gift card cannot be used to obtain any cash advance and is not redeemable for cash or purchase of another gift card. When the cost of a purchase exceeds the gift card balance, the cardholder will be required to pay the difference between the purchase price and the gift card balance. Following a successful transaction, the remaining value of the voucher (if any) will be that proportion of the initial value of the voucher which is unspent immediately prior to the transaction, less the value of the goods and services the subject of the transaction (Remaining Value). The Remaining Value may be used in whole or in part for future purchases at participating stores. No change will be given in respect of any transaction. The voucher cannot be used to obtain any cash advance and is not redeemable for cash or purchase of another voucher. The voucher may only be used to make purchases at participating stores for a total value up to the initial value. When the cost of a purchase exceeds the voucher balance, the cardholder will be required to pay the difference between the purchase price and the voucher balance. - The Major Prize draw will be conducted on 25 July 2011 at Prime Focus, Suite 403/62 Beach Street Port Melbourne, Vic 3207, at 12:00 midday (AEST). The first valid entry randomly drawn will win the Major Prize.
- For Minor Prizes, the Promoter will randomly determine 100 winning times during the Promotion Period (Winning Time). A Minor Prize will be awarded to the first valid entry received (from an entrant who hasn’t previously won a Minor Prize) at or after a particular Winning Time. The maximum number of instant win Prizes to be distributed for this Promotion is 100.
- The provisional winner of the Major Prize will be notified by telephone and mail within 2 working days of the draw. If the winner of the Major Prize entered the Promotion via SMS Entry, the winner must provide the Promoter with the winner’s address when contacted via telephone by the Promoter to enable the Promoter to notify the winner in writing.
- All provisional winners of a Minor Prize will be notified immediately by return SMS (for SMS Entries) or via a website pop up (for Online Entries). Provisional winners of a Minor Prize will be subsequently notified by telephone and mail within 2 working days of winning. If the winner of a Minor Prize entered the Promotion via SMS Entry, they must provide the Promoter with their address when contacted via telephone to enable the Promoter to notify the winner in writing.
- All provisional winners may be required to send the Promoter their Original Purchase Receipts & Original Product Barcodes for all entries as proof of purchase within 7 days of request to a reply paid address to verify their Prize win. If a provisional winner does not provide their Original Purchase Receipts & Original Product Barcodes upon request, their entry will be deemed invalid.
- The name of the Major Prize winner will be published in The Australian newspaper on 07 August 2011.
Unclaimed Prize Draw
- If necessary, a second chance draw will be held on 21 November 2011 at the same time and place as the first Major Prize draw in order to distribute any unclaimed Prizes (including Minor Prizes) or to distribute any Prizes awarded in respect of an invalid entry, subject to any directions given by any of the relevant State gaming authorities. The first valid entry randomly drawn for each unclaimed Prize will win that Prize. All valid entries received during the Promotion Period (other than those relating to a winner whose entry or entries are deemed invalid by the Promoter in accordance with these Conditions) will be eligible to win any unclaimed Prize, except entrants who have won a Minor Prize cannot win another Minor Prize in the unclaimed Prize draw.
- All winners of an unclaimed Prize will be notified by telephone and mail within 2 working days of the second chance draw. The winner of the unclaimed Prize draw must provide the Promoter with the winner’s address when contacted via telephone to enable the Promoter to notify the winner in writing. The winner/s of any unclaimed Prize will be published in The Australian newspaper on 02 December 2011.
- The Promoter’s decisions on all aspects of this Promotion are final, and no correspondence will be entered into.
- All entries are deemed to be received by the Promoter at the time of receipt into the Promoter’s database and not at the time of transmission by the entrant.
- The Promoter, in its discretion, reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, including but not limited to, by using techniques designed to avoid payment of call costs or by using techniques designed to avoid purchasing the Promotion Products by making a Prize claim with stolen, forged, mutilated or tampered with Promotion Products or Product Barcodes, or who submits an entry that is not in accordance with these Conditions.
- Unless otherwise due to fraud or ineligibility under these Conditions, all Prize claims in excess of the advertised total Prize pool will be honoured. Printing errors or other quality control matters outside of the control of individual entrants shall not be used as the sole basis for refusing to award the Prize.
- The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the Promotion.
- If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its absolute discretion to modify the terms of the Promotion including the Prizes and these Conditions, subject to approval of the relevant State gaming authorities.
- If a Prize is won by a person under the age of 18, the Prize will be awarded to the winner’s parent or guardian on their behalf.
- Any tax liability arising as a result of accepting any Prize is the responsibility of the winner.
- Except for any liability which cannot be excluded by law, or which is caused by the negligence or wilful misconduct of the Promoter, the Promoter:
- is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person’s property related to or resulting from participation in this Promotion;
- accepts no responsibility for any incorrect or inaccurate information, either caused by users or by any of the equipment or programming associated with or utilised in connection with this Promotion, or by any technical error that may occur in the course of this Promotion, including (but not limited to) any failure of the computer system or other equipment to determine winners in accordance with these Conditions; and
- accepts no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries or entrants details.
- The Prizes are subject to the terms and conditions of Metcash Trading Ltd, Impeach Pty Ltd and Flight Centre Ltd. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of Metcash Trading Ltd, Impeach Pty Ltd or Flight Centre Ltd.
- The Promoter and its associated companies and agencies will not be liable for, and by receiving, taking or using any Prize each winning entrant is deemed to release the Promoter and its associated companies and agencies from, any loss or damage which is suffered (including personal injury) as a result of receiving, taking or using any Prize except for any liability which cannot be excluded by law or which is caused by the negligence or wilful misconduct of the Promoter. The Promoter holds the benefit of this clause on its own behalf and as trustee for its associated companies and agencies.
- All claims and entries become the property of the Promoter.
- By entering this Promotion, each entrant consents to the Promoter using the entrant’s personal information to administer the Promotion and announce the winner and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). By entering into this Promotion, each entrant also consents to their personal information being used by the Promoter for future marketing and promotional purposes (other than marketing or promoting via email). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth).
